In Glebow Realty Associates v Dietrich, 2020 NY Slip Op 50192(U) (Civ.Ct. NY Co.), the landlord brought an eviction proceeding against David’s client based on the expiration of a supposedly “commercial” lease. In fact, although the lease was nominally commercial, it was always known and understood that the tenant would reside as well as work in the loft. After a hotly contested trial, the court ruled for David’s client and dismissed the proceeding.
