In 1999, David’s client attempted to purchase the fixtures and move into a loft covered by the Loft Law. The landlord sued. The client, represented by different counsel, agreed to a stipulation allowing him to reside in the loft for a year at a rent above the legal Loft Law rent. Over the next 17 years, the landlord amended the stipulation allowing the client to remain but at ever increasing, and illegal, rents.
David recognized that the court stipulations were a scam designed to deprive the client of his rights under rent stabilization.
